Welcome to iknowla. These Terms and Conditions govern your access to and use of iknowla's website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

"Service" refers to the iknowla application, which is a personal knowledge management system with AI capabilities.

"User" refers to the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

"Content" refers to all information, data, text, graphics, and other materials uploaded, collected, or accessed through the Service.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

You can register and authenticate using our trusted identity provider, Clerk. You may also be able to enable multi-factor authentication for enhanced security.

iknowla offers various subscription plans with different features and limitations. Details of each plan are available on our pricing page.

Subscription fees are billed in advance on either a monthly or annual basis based on your selected plan. Your subscription will automatically renew unless you cancel it before the renewal date.

For any paid plans, you agree to provide current, complete, and accurate purchase and account information. You also agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

We process payments through Stripe, a secure third-party payment processor. Your payment information is subject to Stripe's privacy policy and terms of service.

The Service allows you to create, upload, store, and share content. You retain all rights to your content, and iknowla makes no claim of ownership over your content.

By using the Service, you grant iknowla a license to access and use your content solely for the purposes of providing and improving the Service, according to your preferences and these Terms.

You represent and warrant that your content does not violate any third-party intellectual property or other rights, and does not violate any applicable laws.

iknowla uses artificial intelligence to enhance your experience through features like automatic categorization, tagging, connections, and AI-assisted chat.

When you use these features, your content is processed by our AI systems to provide the requested functionality. This processing is conducted securely and in accordance with our Privacy Policy.

Results and suggestions generated through AI features are provided as-is and should be reviewed by you before using them for any important decision-making.

iknowla implements rate limiting and usage caps based on your subscription plan. You agree not to circumvent these limitations through multiple accounts or automated means.

iknowla stores your data in a secure, isolated environment with strict access controls. Your data is stored using Redis KV storage with per-user data isolation through prefixed keys.

The Service implements multiple security measures including but not limited to: authenticated API endpoints, rate limiting, input validation, content sanitization, and secure handling of API keys.

While we implement reasonable security measures, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

You agree not to use the Service to:

• Engage in any activity that is illegal, harmful, or interferes with any other user's access to the Service
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Collect or harvest any personally identifiable information
• Use the Service for any commercial purposes without our consent
• Infringe upon or violate our intellectual property rights or those of others
• Use the Service in a manner that exceeds reasonable usage parameters or creates an undue burden on our infrastructure

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of iknowla and its licensors.

The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or request account deletion through our settings page.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

In no event shall iknowla, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service, including AI-generated content
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

iknowla and its licensors do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

iknowla does not warrant or make any representations concerning the accuracy, reliability, or quality of any AI-generated content, and disclaims all responsibility for decisions made based on such content.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
